How to answer the question if we offer company cars?
Talk Track
VERSION 1: SHORT
Pillars: Compliance, Transparency
We do not offer company cars or car leasing as part of our Employer of Record service, as this creates compliance challenges and increases permanent establishment risk. This is not unique to WorkMotion, other EOR providers also cannot support this compliantly. Instead, we recommend a transport allowance added via the platform and processed through payroll.
VERSION 2: MEDIUM
Pillars: Compliance, Trust, Transparency
We do not provide or lease company cars through our Employer of Record model, as this introduces legal and tax complexities, including an increased risk of permanent establishment due to the separation between benefit ownership and legal employment. This is a broader limitation of the EOR model, and compliant providers in the market will take the same approach. To ensure everything remains compliant and straightforward, we recommend a transport allowance added via the platform and processed through payroll, giving you a clear and consistent structure across countries.
VERSION 3: LONG
Pillars: Compliance, Trust, Effortless
That is a very valid question, especially when aligning benefits across multiple countries. We do not offer company cars or leasing through our Employer of Record entities, as this creates a structural mismatch between who provides the benefit and who is legally responsible. This introduces tax and legal complexity and can increase the risk of permanent establishment if not managed correctly.
It is also important to note that this is not specific to WorkMotion. Any EOR provider operating in a compliant manner will face the same limitation, as the underlying risk comes from the employment structure itself rather than the provider.
Our focus is to keep your setup compliant and operationally simple across markets. For that reason, we recommend a transport allowance added via the platform and processed through payroll, which provides flexibility for the employee while maintaining a clean and compliant framework.
If a company car is essential for your setup, we can take this forward internally and investigate whether there are any potential solutions based on the country and business case.
