In principle, the setting up of employee representatives is voluntary in Slovakia, and the initiative must come from employees.

Slovak Labour Code recognises three types of representation:

  1. employees´ trustee – a single person (if the employer employs 3 to 49 employees);

  2. works council (if the employer employs at least 50 employees); or

  3. labour union (requires setting up a civic association).

If an employee initiates a request to form a representative body, WorkMotion, as the employer, is obliged to allow them to appoint a representative, enable its operation, and cooperate as needed. However, in a remote work setup, it is rather uncommon to have employee representatives in place.
