Can we have a different notice period based on the seniority of the talent with the client?
Yes, it's possible. The only thing you need to make sure of is that the notice period is always the same for both talent and WM.
Example below: 1 month of notice in the 1st year of employment, 2 months of notice in the 2nd year
Here is the wording:
DE: Für beide Vertragspartner gilt eine vertragliche Kündigungsfrist von 1 Monat (innerhalb des ersten Beschäftigungsjahres) und 2 Monaten (innerhalb des zweiten Beschäftigungsjahres) zum Ende des Kalendermonats, wobei eine gesetzliche Verlängerung der arbeitgeberseitigen Kündigungsfristen gemäß § 622 Abs. 2 BGB auch für den Arbeitnehmer gilt.
EN: The Parties shall observe a contractual notice period of 1 month (within the first year of employment) and 2 months (within the second year of employment) to the end of a calendar month. Any statutory or other prolongation of the notice period which is mandatory for the Employer according to Sec. 622 para. 2 BGB shall also apply to the Employee.
