Can a Talent work on Blue Card Visa in Germany if the Visa will be expired in few months?
In case of Blue Card Visa, as soon as the employee gets terminated from his/her employer, the Blue Card visa becomes invalid as it is attached with the job, and the employee has to inform the officials and get the job seeker visa, which will be valid for the period of 3 to 6 months.
The employee will be on a job seeker visa, and the job seeker visa can be valid between 3 and 6 months.
On a Job seeker visa, if the employee gets the job, then WorkMotion can support the employee with the Blue Card visa.
In case the employee doesn't get the job, then he can't stay in Germany after the job seeker visa expiration.
For Blue Card, Either Employee can go ahead and apply for Blue Card Visa or Renewal of Blue card or can take our Vendor's (Jobbatical Support) to apply for the Blue Card.
If the employee will take the ownership to apply for the Visa by him/herself then the need to check with the immigration authority about the process. This will be confirmed by the immigration Authority, if the employee will be issued new Blue Card Visa or can renew the previous blue card. In most cases, the employee has to again apply for new blue card. We need to get below confirmation from the employee itself, in case he wants to process his visa application process by himself:
Has he already informed the Immigration officials about his current situation?
How will he able to manage his stay in Germany if he doesn't get the Blue Card Visa before the Date of Joining?
What is the duration of Job Seeker Visa or How long he can stay in Germany with the Job Seeker Visa?
How is he managing his Health Insurance currently? In case he doesn't get the blue card before joining date what will happen to his health insurance?
If they want to go through with Jobbatical, the following steps would be followed
We need Employee's documents to review his current documents (Current Visa Details copy) then the jobbatical team will be able to suggest if we need to renew his Blue Card or do we need to start a new application for Blue Card as his current blue card will be based on the new contract. The vendor confirmed that The talent can reside in Germany until a decision has been made on his Employment however we need to initiate the application process so that he won't face any issue staying here.
The process to obtain the new permit is generally 2-4 months. Depending on the type of job seeker visa the employee holds, he might be able to start working already though. We would need to review the documents first then we can finally inform the employee.
The actual fee can be confirmed after the documents review process however for Visa renewal or change of employer fee would be approximately up to 400 Euros.
Please note that we can support the employee with the mandatory documents which will be needed for Blue Card application and can onboard him but employee has to first clarify the above queries to us and let us know if they want to take help of the vendor or the employee wants to initiate the process by himself, then we can proceed further with the onboarding process.
What are the EU Blue Card requirements?
You have a German academic qualification or a foreign academic qualification that is comparable to a German academic qualification. In Germany, this qualification must correspond to at least level 6 of the International Standard Classification of Education (ISCED 2011) or level 6 of the European Qualifications Framework.
You already have a specific job offer from a company in Germany. The job offer must meet the following conditions:
The period of employment must be at least six months.
The job must match your qualification (academic degree). If a licence to practise (regulated professions) is required, this must be in place or in prospect at the time of the visa application.
Your job in Germany must enable you to earn a gross annual salary of at least €49,581.6 (as of 2026).
If you are employed in a bottleneck profession, you can also obtain an EU Blue Card with a lower gross annual salary of at least €43,050 (as of 2026) if the Federal Employment Agency (BA) has approved your employment. The salary thresholds are published annually by the Federal Ministry of the Interior and Community.
