In Germany, employees may be covered by both an Employment Contract (EC) and a Deployment Agreement (DA).
When planning offboarding, it’s essential to follow the Employment Contract end date, not the Deployment Agreement end date.
Key Differences
Employment Contract (Arbeitsvertrag):
The core employment agreement between Parakar (the legal employer) and the employee.
Typically indefinite in duration.
Governs the legal employment relationship, including notice periods and termination rights.
Deployment Agreement (Entsendevertrag):
A temporary agreement governing the employee’s assignment to a specific client
Limited in duration, often due to labor leasing regulations in Germany.
Does not define or limit the actual employment relationship—only the client assignment.
Offboarding Tip
The WorkMotion platform may only show the Deployment Agreement end date, which can mislead clients into thinking the employee’s contract is ending.
Always check the Documents section in the employee's profile for both the EC and DA.
Confirm with Parakar, they will clarify which date is legally binding for termination or offboarding.
