Sign-on bonuses are common components of employment packages that require careful consideration of their legal and tax implications. This article clarifies how sign-on bonuses are structured within WorkMotion, explains their relationship to employment rights, and outlines payment and taxation processes.

Definition and Classification of Sign-On Bonuses

A sign-on bonus is a type of bonus or compensation element that forms part of an employment package. By adding this amount, WorkMotion and/or EOR partners are not adding to the Talent's payroll or communicating to any authority that a sign-on bonus amount is retroactively covering for a period of time worked.

Employment Rights and Seniority Implications

The payment of a sign-on bonus does not create retroactive employment rights or benefits. Specifically:

  • It is not granting any retroactive right to the employee in terms of contract seniority.

  • It does not provide coverage on any kind of insurance, accident, or other employment-related protections for periods prior to the contract start date.

  • The bonus amount is not linked to any specific period of time worked.

Tax Considerations

Bonus payments can be taxed differently and at a higher tax rate for the employee compared to regular salary payments. This variation in tax treatment depends on local tax regulations and the classification of bonus payments within the relevant jurisdiction.
